❶ 如何购买破产房产
房地产企业一旦破产,房屋是否建成就决定了该企业事实上是否可能履约。以下将分这两种情况进行讨论。
一、房屋已建成
房屋已经建成的情况下,破产企业即有对购房人履约的可能,也就是业主有可能能够拿到房子。
二、房屋未建成
若企业破产宣告时房屋尚未建成,或人民法院受理破产申请后,管理人决定不再继续修建未建成的房屋,就会造成破产企业对购房人债务履行事实不能的情况。根据房屋的买受方式不同,可以区分为两种情况:按揭贷款买房和对卖方分期付款买房,这两种买房的方式会对房地产企业破产时,房屋的权利归属产生不同影响。
1、按揭贷款所购房屋的权利归属。
企业破产时房屋的权利归属。现房按揭中,开发商破产对房屋的权利归属没有任何影响。购房人仅需继续向银行清偿债务,并以房屋为担保即可。
在期房按揭中,购房时房屋尚未建成,购房人不享有房屋的所有权。当房屋建成后,若房款已经付清(购房人支付了首付,贷款银行以购房人的名义付清了余款),购房人即可委托开发商向当地房地产登记处申领《房地产证》并取得房屋所有权。之后房地产企业的破产对房屋的权利归属亦不生影响,购房人仅需继续向银行清偿债务,并以房屋为担保即可。
2、对卖方分期付款买房时房屋的权利归属。
与按揭买房不同,在分期付款购房的情形下,在转移所有权之前,根据破产申请受理时,购房人是否足额支付价款可以分为以下两种情况讨论:
第一,购房人已经付清全部价款的,所购房屋被排除在破产财产之外,购房人可以要求破产管理人转移房屋所有权,并向房地产管理部门申请变更房屋登记。
第二,购房人尚未付清全部价款的,房地产企业尚未转移所有权,双方均未履行完毕合同,破产管理人即有权决定是解除合同还是接受价款并转移房屋所有权。

首先从看好房子开始讲。
去售楼处交订金,并同时签订认购书和确定签署正式合同的时间。(这期间特别要注意详细查看开发商提供的“五证”及相关文件)。
按照约定时间与开发商签订正式的购房合同,按合同约定的付款方式交纳购房款项。
在规定期限内,由开发商协助到当地的房地产交易管理部门办理预售合同的登记手续,并按规定交纳印花税。
合同登记后,需要办理购房贷款的,可以着手办理抵押贷款手续。
具体办理办法,可向有关部门咨询。
十、房屋竣工验收合格后,开发商提供“入住通知书”及“收楼须知”,销售部、物业公司财务部、管理处到现场集中办公,着手办理业主入住手续。
业主办理入往手续同时应携带相应的证件、购房合同,办理手续如下:
(1)到开发商售楼处交纳购房余款。
(2)领取《住宅使用说明书》、《住宅质量保证书》及有关装修规定和表格。
(3)由销售部或物业部陪同业主验房,签署“楼宇交接书”。
(4)与物业公司签订《物业管理公约》。
(5)按规定交纳首期物业管理费,灶具报装费,有线电视报装费,电话初装费等(不同物业有不同规定)。
(6)新业主领取房屋钥匙,办理装修或入住手续。
以上基本上是每一位购房者都必须经历的购房全过程,希望能对花茶购房有所帮助。对了,还有按揭。如果按揭的话交完定金一般是一个星期内补齐首期,然后去银行办理按揭,一般打点的发展商办理按揭都是直接在售楼处的。然后自己根据自身的情况选择按揭的年限长短就可以了
